Seed Keep Terms of Service

Last updated July 30, 2026

Overview

Here’s a short overview.

  • Every seed and season is unique, and we can’t promise a successful crop. Our planting suggestions are based on past weather averages and plant needs. We help you plan, but we can’t guarantee a successful garden or harvest.

  • We don’t verify that any plant is safe to eat. Seed Keep may flag some plants that are known to be risky, but we don’t catch everything, and the absence of a warning never means a plant is safe. Always confirm for yourself that a plant is safe before eating it or growing it around children, pets, or animals.

  • Payments and subscriptions are automatically charged through your Apple Account. If there’s a problem with a payment, please contact the App Store.

  • Sometimes there will be a link to a third-party website. We don’t control the content of those and aren’t responsible for the information they publish, so please be careful.

  • Our responsibility is limited. Like most apps, there are limits on what we are legally responsible for, and disputes are handled by individual arbitration — though you can opt out of arbitration within 30 days (see Section 18.7). The full details are below.

This summary is for your convenience, but the full Terms below are what legally apply and you should read them.

Full Terms of Service

Welcome to Seed Keep (the “App”), operated by Sunkroft, LLC (“Sunkroft,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the App. The App is offered for users in the United States and Canada. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What the App Does

The App lets you scan seed packets. It attempts to identify the packet details, then uses a database of plant needs together with a climate model built from historical weather data to suggest a planting window. These are suggestions and estimates only.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the App, you confirm that you meet these requirements.

3. License to Use the App

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App for your own personal, non-commercial gardening use, subject to these Terms. We reserve all rights not expressly granted to you.

4. Intellectual Property

The App and its software, design, text, graphics, growing data, climate models, and outputs are owned by Sunkroft or its licensors and are protected by intellectual-property and other laws. Seed Keep, Sunkroft, and our associated names and logos are trademarks of Sunkroft and may not be used without our prior written permission. Third-party names and logos that appear in the App belong to their respective owners. These Terms do not alter rights granted under licenses applicable to third-party or open-source software included in the App.

5. Acceptable Use

You agree that you will not:

  • copy, modify, distribute, sell, lease, or sublicense any part of the App;
  • reverse engineer, decompile, or disassemble the App, or attempt to extract its source code, except to the extent this restriction is prohibited by applicable law;
  • access, scrape, harvest, or extract the growing data, the climate model, or any other data from the App through automated means (such as bots, scrapers, or crawlers), or use any part of the App to build or train a competing or derivative product, dataset, or model;
  • use the App in any way that violates applicable law, infringes the rights of others, or interferes with or disrupts the App or its servers;
  • remove or alter any proprietary notices; or
  • circumvent or attempt to circumvent any access or security controls.

6. User Content

The App may let you create or upload content such as notes, photos, and garden activity logs (“User Content”).

You own your User Content. The App may store or synchronize User Content using Apple services, including iCloud, under the Apple Account and settings associated with your device. Your use of those services is governed by your agreements with Apple. Sunkroft does not operate your Apple or iCloud account and may be unable to access, recover, delete, or control content stored in your private iCloud account.

To the limited extent User Content is transmitted to or processed by Sunkroft, you grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, display, and format that content solely as needed to operate, provide, and improve the App.

You are responsible for your User Content. You represent that you own it or have the necessary rights to submit it, and that it does not infringe anyone’s rights or violate any law. You agree not to submit content that is unlawful, infringing, harmful, or that violates the privacy or rights of others. To the fullest extent permitted by law, Sunkroft is not responsible for loss of User Content.

Our Privacy Policy, available at https://seedkeepgarden.app/privacy/, explains how information is collected, used, disclosed, retained, and protected.

7. Planting Windows and Identifications Are Estimates, Not Guarantees

The planting windows the App provides are based on historical weather averages. Actual weather varies from year to year and from place to place, and many factors affect whether a crop succeeds, including soil, pests, disease, water, sunlight, your gardening practices, and conditions we cannot predict.

The App may also misread a seed packet or misidentify a plant. Always confirm the identity of any plant yourself before planting, handling, or consuming it, and do not rely on the App as your only source of identification.

Following a planting window suggested by the App does not guarantee a successful crop. You accept that you may lose plants, seeds, time, money, or an entire crop, and that we are not responsible for those losses.

8. Safety and Toxicity Warnings Are Incomplete

Some plants are dangerous to humans, pets, or livestock. The App may display a warning for certain plants known to be hazardous (for example, sweet pea), but our safety database is not comprehensive and does not cover every plant, part of a plant, or risk. The App does not assess, verify, or represent that any plant is safe to eat.

The absence of a warning does not mean a plant is safe. It is your sole responsibility to confirm that any plant is safe to grow, handle, and eat, and that it is safe around children, pets, and animals, before doing so. When in doubt, consult a qualified professional (such as a doctor, veterinarian, poison control, or local agricultural extension office). Never eat any plant you cannot positively confirm is safe.

9. Not Professional Advice

The App provides general gardening information only. It is not professional horticultural, agricultural, medical, veterinary, nutritional, toxicological, or legal advice, and it is not a substitute for the judgment of a qualified professional. Do not rely on the App to make decisions affecting your health or safety or that of others.

10. Third-Party Data and Sources

The App relies on third-party and external data, including plant information, seed packet content, and historical weather data. We do not control and do not guarantee the accuracy, completeness, or timeliness of that data, and we are not responsible for errors or omissions in it.

Links are provided for your convenience and do not imply a recommendation or endorsement. If you decide to use a third-party service, you do so at your own risk and subject to that third party’s terms and privacy practices.

11. Feedback

If you send us suggestions or feedback about the App, you grant Sunkroft a worldwide, perpetual, irrevocable, royalty-free right to use that feedback for any purpose without compensation or obligation to you. Please don’t send feedback containing confidential information or material you don’t have the right to share.

12. Subscriptions and Billing

The App may offer access to paid features through an automatically renewing subscription. The subscription period, price, included features, and any trial or promotional terms will be displayed before purchase. Payment will be charged to your Apple Account when you confirm the purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. Your Apple Account will be charged for renewal within 24 hours before the end of that period at the price disclosed by Apple, subject to any price-change notice or consent required by Apple or applicable law. Renewal and cancellation mechanics are administered by Apple and may change; if the terms Apple displays at the time of purchase differ from this section, Apple’s terms control.

You can manage or cancel a subscription through your Apple Account subscription settings. Deleting the App does not cancel a subscription.

Apple administers App Store billing and refund requests, and we cannot issue refunds for purchases charged through Apple. If you have a billing dispute, please contact Apple. Refund eligibility is governed by Apple’s policies and applicable law; you may request a refund from Apple at https://support.apple.com/en-us/118223. Nothing in these Terms limits refund or cancellation rights that cannot lawfully be limited.

13. Changes to the App

We are always working on the App, and we may add, change, suspend, or discontinue features at any time. We do not promise that any feature will always remain available. Any change affecting a paid subscription remains subject to applicable law and Apple’s requirements.

14. Termination

You may stop using the App at any time by deleting it (subscriptions must be canceled separately through your Apple Account settings). Your license automatically terminates if you materially violate these Terms; upon termination, you must stop using the App and delete any copies.

Sections that by their nature should survive termination — including intellectual property, feedback, warranty disclaimers, limitation of liability, disputes, and governing law — will survive.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the App, its data, its identifications, or its recommendations will be accurate, complete, reliable, current, uninterrupted, secure, or error-free. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SUNKROFT AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST CROPS, LOST SEEDS, LOST TIME OR LABOR, WASTED EXPENDITURES ON GARDENING EQUIPMENT, SUPPLIES, OR SERVICES, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF SUNKROFT AND THE OTHER PARTIES IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $20 USD.

These limitations do not exclude or limit liability for fraud, willful misconduct, gross negligence, or any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Sunkroft and its members, managers, employees, and contractors from third-party claims, damages, and reasonable costs arising from (a) unlawful or infringing User Content you provide; (b) your material violation of these Terms; or (c) your commercial, unlawful, or unauthorized misuse of the App.

18. Dispute Resolution and Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING A CLAIM IN COURT AND HAVE A JURY TRIAL.

18.1 Informal Resolution First

Before starting arbitration, the party raising a dispute must send the other party a written notice describing the dispute and requested relief. Notices to Sunkroft must be sent to support@sunkroft.com. Sunkroft may send a notice to you using contact information you voluntarily provided, if any. You and we will attempt in good faith to resolve the dispute for 60 days after receipt of the notice.

18.2 Agreement to Arbitrate

Except for the matters described in Section 18.5 and to the extent permitted by law, you and Sunkroft agree that disputes arising out of or relating to the App or these Terms will be resolved through binding individual arbitration rather than in court. The arbitrator may decide disputes concerning the interpretation, scope, enforceability, or validity of these Terms or this arbitration agreement, except that a court will decide disputes concerning the enforceability of the class-action waiver in Section 18.6. If the law of your jurisdiction (for example, certain Canadian provinces) does not permit mandatory arbitration of consumer disputes, this Section 18 applies to you only to the extent permitted by that law.

18.3 Rules and Procedure

Arbitration will be administered by the American Arbitration Association (“AAA”) under its then-current Consumer Arbitration Rules, as modified by these Terms. A single arbitrator may award the same individual remedies that a court could award. The arbitration may take place in Travis County, Texas, or, at your choice, by telephone, video, or written submissions, subject to the AAA rules and applicable law.

The AAA rules are available at https://www.adr.org/consumer. If AAA is unavailable or unwilling to administer a dispute consistent with this section, the parties will select another mutually agreeable administrator or ask a court of competent jurisdiction to appoint one.

18.4 Governing Arbitration Law

The Federal Arbitration Act and applicable federal arbitration law govern this arbitration agreement. Subject to that Act, Texas law governs the underlying dispute as provided in Section 22.

18.5 Exceptions

This arbitration agreement does not prevent either party from (a) bringing an eligible individual claim in small-claims court, as long as it remains there and proceeds individually, or (b) seeking injunctive or equitable relief in court concerning infringement or misuse of intellectual-property rights. Nothing in this section prevents a party from reporting a matter to a governmental agency or seeking relief that applicable law does not permit to be waived.

18.6 Class-Action Waiver

To the fullest extent permitted by law, disputes must be brought only in an individual capacity and not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding. Unless both parties agree, an arbitrator may not combine more than one person’s claims or preside over a class or representative proceeding.

If a final decision finds this class-action waiver unenforceable as to a particular claim or request for relief, that claim or request for relief will be severed and resolved in court after all arbitrable claims have been completed. If applicable law does not permit that severance, this Section 18 will be unenforceable as to that dispute.

18.7 Right to Opt Out

You may opt out of this Section 18 by sending notice to support@sunkroft.com within 30 days after first accepting these Terms. The notice must state that you are opting out of arbitration and include your name and the email address or Apple Account name you use with the App, so we can match your opt-out to any later dispute. Opting out of arbitration does not affect the rest of these Terms.

18.8 Arbitration Fees

Payment of filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules. Sunkroft will pay or reimburse fees when required by those rules or applicable law.

19. Time Limit on Claims

To the fullest extent permitted by law, any claim arising out of or relating to the App or these Terms must be brought within one year after the claim accrued; otherwise, it is permanently barred. This limitation does not apply where applicable law prohibits shortening the relevant limitations period.

20. Changes to These Terms

We may update these Terms to reflect changes to the App, the law, or our practices. We will provide reasonable notice of material changes through the App, an App Store update description, our website, or another reasonable method. The updated Terms will state when they take effect.

If a change materially affects existing legal rights, it will apply prospectively unless you affirmatively agree otherwise. Your continued use of the App after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree, you must stop using the App.

21. Terms Required by Apple

21.1 Parties and Responsibility

These Terms are between you and Sunkroft only, not Apple. Sunkroft, not Apple, is solely responsible for the App and its content. These Terms do not create usage rules that conflict with the Apple Media Services Terms and Conditions as of the date these Terms take effect.

21.2 Maintenance and Support

Sunkroft is solely responsible for maintenance and support services for the App as specified in these Terms or required by applicable law. Apple has no obligation to provide maintenance or support for the App.

21.3 Warranties

Sunkroft is solely responsible for any App warranties that are not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation concerning the App. Sunkroft is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty, subject to these Terms and applicable law.

21.4 Product Claims

Sunkroft, not Apple, is responsible for addressing claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to satisfy legal or regulatory requirements, and claims under consumer-protection, privacy, or similar laws.

21.5 Intellectual-Property Claims

If a third party claims that the App or your possession and use of it infringes that party’s intellectual-property rights, Sunkroft, not Apple, is responsible for investigating, defending, settling, and resolving that claim.

You represent that you are not located in a country or region subject to a United States government embargo or designated by the United States government as supporting terrorism, and that you are not listed on a United States government list of prohibited or restricted parties.

21.7 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right — and will be deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.

22. Governing Law and Venue

Except as provided in Section 18 and subject to non-waivable consumer protections, these Terms are governed by Texas law without regard to conflict-of-laws rules.

Any court proceeding permitted under these Terms — for example, a claim brought after opting out of arbitration under Section 18.7, or a claim described in Section 18.5(b) — must be brought exclusively in the state or federal courts located in Travis County, Texas, and you and we consent to personal jurisdiction and venue in those courts. This paragraph does not apply to small-claims court proceedings under Section 18.5(a) or where applicable law requires a different forum.

23. General Terms

If any provision is invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will remain effective.

Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a merger, reorganization, financing, sale of assets, or transfer of the App. Any attempted assignment contrary to this paragraph is void.

Except for Apple and its subsidiaries as stated in Section 21.7, these Terms do not create third-party beneficiary rights.

These Terms and the policies expressly referenced in them constitute the entire agreement between you and Sunkroft concerning the App and replace prior agreements or understandings on that subject.
